Acceptance of terms

These terms and conditions govern all supply of goods and services ("products") by ProKoa Consulting Ltd ("ProKoa Bed Linen, "we, "us") to you, the purchaser of goods and services from us, including your use of the website at www.prokoa.nz ("the website"). They are effective from 11 November 2022 and will replace all earlier ProKoa Consulting Ltd terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.
We reserve the right to change these terms of trade by notice to you. Notice will be given by posting the revised terms and conditions on our website.

To make a purchase from our online shop you must be 18 years of age or over.
Purchases from ProKoa Bed Linen online shop may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).
If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.


Availability and supply

All orders are subject to the availability of those products or services. If for any reason a Product is not available, we will endeavour to notify the non-availability on our online shop.

Delivery and delivery charges

Prices for goods and services stated on our website are exclusive of any applicable delivery charges.
We only deliver to New Zealand street addresses. The cost of delivery is as stated on our website and a total delivery cost will be provided in the order summary in your online shopping basket.
We will use all reasonable endeavours to ensure that orders for tangible goods will be dispatched promptly after an order has been placed.


Pricing

All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax ("GST") unless stated to be otherwise but are exclusive of delivery charges. All prices are correct when published. We reserve the right to alter prices at any time.
An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.

We also accept payment from your PayPal account if you have one.

Shipping and delivery

We deliver throughout New Zealand to valid New Zealand addresses.
Please note we do not ship to PO Box addresses.
All deliveries are sent out with no-signature required.
We endeavor to prepare and ship your order within 24hrs of your order being received.
Shipping is via courier, delivery time 3-5 working days.
Standard shipping cost to North Island or South Island is NZ $11.00; Rural address delivery for North Island or South Island is NZ $17.00;

Returns

At ProKoa Bed Linen we stand by the quality of all of our products and are committed to ensuring that all our customers are satisfied with each purchase. In certain circumstances however, you may want to return some items. Please refer to information below and contact us via email at info@prokoa.nz and we will do our best to assist you.

Returnable items

Items that can be returned/refunded or exchanged follow the criteria as below:

  • Items damaged or soiled upon arrival.
  • Items received in the incorrect size/colour/design.
Exceptions for Returned Products

Due to hygiene reasons we cannot accept returns of ProKoa duvet sets unless they are faulty. If the product is faulty we will meet our obligations under the Consumer Guarantees Act to provide a remedy. We also do not return/refund special make items or items marked "sale"/"clearance" products, as they are on sale to clear.

If the return is a result of our error, please contact us so we can discuss a method of return shipping. Please note you have 30 days to advise us if any mistakes have been made on your order.

Returns We Can't Accept

If you refuse to take the delivery package from the postman/courier or do not pick up your delivery package from your local pick-up stores, we will not be able to judge the situation of the package and therefore cannot handle your return requests.

If the package is returned to us because of a customer's personal reason (check details below), we'll contact you about re-paying the re-shipment postage and arrange the re-shipment. However, please understand that no refund will be issued in this situation.

Details for customer's personal reason:

  • Wrong address/no consignee
  • Invalid contact information/ no answer to the delivery calls & emails
  • Customer refuses to accept package/pay tax fee/ complete customs clearance
  • Didn't collect package by the deadline
*7 Days No Reason Return/ Change of Mind

If you change your mind about the purchase you may return it to us within 7 days of delivery, with the condition the product remains in its original, unopened, unused condition complete with all original packaging and tags.

Please note we charge a NZ $10.00 restocking fee which be deducted from the purchase price. You will be expected to ship the item back to us at your expense. Please contact us on info@prokoa.nz for the returning address.

Please note if you are returning an item for a refund we are bound by our bank agreement to refund to the original credit card used only. If this is not possible (i.e. your credit card has been cancelled or has expired) and we need to refund you in a different method to that originally used, a fee based on the original purchase price will be charged to you.

Please note a refund or credit note will be issued within 14 working days of receipt of the return.

Return Address

Contact us by mail info@prokoa.nz to obtain the return address. Please DON'T return your package to any address indicated on the shipping label of the package received, we cannot be held responsible if packages are returned to the wrong address.

Important - No Postal Deliveries are accepted - COURIER ONLY.

Damaged Items

Prokoa Bed Linen abides by the Consumer Guarantees Act for any faulty or damaged items. If the product is faulty we will meet our obligations under the Consumer Guarantees Act to provide a remedy.

Items Damaged in Transit

If for any reason you are unhappy with the condition your item has arrived in please contact us immediately so we can remedy the situation. Please ensure you keep all of the contents including the packaging the goods arrived in. We have a limited timeframe during which we can lodge claims with our external courier companies so we ask you please contact us in a timely manner.

Please note we take no responsibility for international orders damaged in transit. We package our goods safely and securely so they turn up to your doorstep in the best condition possible.

Returning Orders Exceeding NZ $450.00.

If your order exceeds NZ $450.00 and you return it for a refund you will be expected to pay the original freight cost- for which an invoice will be issued, and a re-stocking/admin fee of 5% of the value of the order will also be deducted from your refund.

Packaging

At Prokoa Bed Linen we love the environment! We try to recycle as much as possible so please don't be offended if your order arrives in a recycled packaging. Rest assured we do not compromise on packaging your goods safely and securely so they turn up to your doorstep in the best condition possible!

International Shipment

For orders destined outside of New Zealand the shipment service we select is dependent on the size of parcels we are sending. Please contact us at info@prokoa.nz so we can provide shipment costs based on your order.

All international sales are final and we do not accept any returns for international purchases.

For any orders shipped outside of New Zealand the customer is the importer of the product and will be responsible for all customs import duties and sales tax charges. These charges vary in each country and are outside of our control. Contact your local customs office for more information on what import duties or sales taxes may be imposed in your country.

Liability Limitation

Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.
We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.
To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us.
This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.
Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.

Applicable law and jurisdiction

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.
Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.
Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).
You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.

Privacy policy and Confidentiality

Your privacy is very important to us at Prokoa Bed Linen. We have established and implemented information handling practices we believe are consistent with the highest standards and best practices of organizations doing business on the internet.
This privacy policy describes the practices that apply to our site, including, specifically, the information we collect about you, when and how we collect that information and what may happen to that information.
We will not collect personally identifiable information like your name, e-mail and mailing/postal address and telephone number ("Personal Information") without your knowledge and permission;
We will not disclose your Personal Information to third parties unless you have authorized us to do so, except as required by law.
The personal information you submit when placing your order is treated as confidential. We use this information to process your transaction, and we share the information with Visa, Mastercard, etc. in order to process your order.

You will need to permit us to place data files ("cookies") on your computer to enable you to use some features of some of our websites. Where you choose not to enable cookies from our Website, some functionality of those Website may not be available to you.
We cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control.
You can request details of your personal information that we hold, and ask us to correct it, at any time.


General Conditions

If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we hav

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.
Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.
We may deliver notices to you by sending them to an email address that you have notified to us.
